3. MEMBERSHIP
3.1 Participation by EMPLOYERS
3.1.1 The conditions of membership of the FUND shall be those contained in the AGREEMENT.
  3.1.2 Any other EMPLOYER not bound by the AGREEMENT may participate in the FUND by applying in writing to the BOARD.  Their participation is subject to the approval of the BOARD and to the conditions that the BOARD, in consultation with the ADMINISTRATOR, may lay down.
3.2 Participation by EMPLOYEES
  3.2.1 Every EMPLOYEE qualifies for MEMBERSHIP of the FUND in accordance with the AGREEMENT.
  3.2.2 An EMPLOYEE who was a member of the OLD FUND immediately before the PARTICIPATION DATE must become a MEMBER of the FUND on the PARTICIPATION DATE if he/she is still in the service of the EMPLOYER.
  3.2.3 An EMPLOYEE who entered the service of the EMPLOYER before the PARTICIPATION DATE and has since then remained in the EMPLOYER’S service without interruption and was not a member of the OLD FUND immediately before the PARTICIPATION DATE, must become a MEMBER of the FUND immediately in terms of the AGREEMENT.
  3.2.4 Every EMPLOYEE who enters the service of the EMPLOYER on or after the PARTICIPATION DATE, becomes a MEMBER of the FUND with effect from the date on which he/she qualifies for MEMBERSHIP, provided that the EMPLOYER has timeously advised the ADMINISTRATOR.

The requirement in this sub-RULE must be laid down by the EMPLOYER in terms of the AGREEMENT as a condition of employment of its EMPLOYEES.

  3.2.5 Secondment – If an EMPLOYER seconds a MEMBER for a contracted period to another country, the MEMBER continues to be a MEMBER of the FUND. The EMPLOYER shall advise the ADMINISTRATOR of such MEMBER.  For the purposes of the RULES, the MEMBER’s REMUNERATION will be as advised each year by the EMPLOYER to the ADMINISTRATOR.  Contributions by and in respect of the MEMBER will continue and benefits will not be forfeited.
  3.2.6 Temporary absence means if a MEMBER is absent from service and such absence is authorized by the EMPLOYER, the payment of contributions may or may not be continued for such period depending on the agreement with the MEMBER.  The EMPLOYER will advise the ADMINISTRATOR accordingly. Where the contributions continue during the period of absence, these will be based on the REMUNERATION received during such period unless the EMPLOYER advised the ADMINISTRATOR of some other amount.
3.3 Termination
  3.3.1 A MEMBER’s MEMBERSHIP may not be terminated as long as he/she remains an    EMPLOYEE in terms of the AGREEMENT.
  3.3.2 A MEMBER’s MEMBERSHIP terminates –

(a)     at the MEMBER’s death; or
(b)     as soon as the MEMBER, after he/she has ceased to be an EMPLOYEE,  ceases to be entitled to a benefit in terms of the RULES; or
(c)     at the dissolution of the FUND.

Whichever event occurs first.
